The plain-English terms that govern your use of the Sellers First Home Solutions website and our Houston home-selling services. Please read before you continue.

1. Acceptance of Terms

By accessing or using the website located at sellersfirsthomesolutions.com (the 'Site'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, please do not use this Site.

These Terms constitute a legally binding agreement between you and Sellers First Home Solutions, operated by Maxwell Buffamante, a licensed Texas real estate agent affiliated with eXp Realty, LLC (TREC License #9006162), and Logan (collectively, 'Company,' 'we,' 'us,' or 'our').

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. TREC Licensing & Brokerage Disclosure

Maxwell Buffamante is a licensed real estate agent in the State of Texas, affiliated with eXp Realty, LLC, a licensed Texas real estate broker. All real estate brokerage services are provided in compliance with the Texas Real Estate License Act (TRELA), Texas Occupations Code Chapter 1101, and rules promulgated by the Texas Real Estate Commission (TREC).

MANDATORY TREC DISCLOSURES: The Information About Brokerage Services form (IABS) and Consumer Protection Notice are available upon request and linked in the footer of this website. These disclosures are required by Texas law.

eXp Realty, LLC is supervised by eXp Realty's designated broker. A licensed Texas real estate agent acting as a seller's agent represents the interests of the seller and owes fiduciary duties to the seller. Buyers are encouraged to seek their own representation.

We are members of the Houston Association of REALTORS® (HAR) and adhere to the National Association of REALTORS® Code of Ethics.

3. Real Estate Services & No Guarantee of Offers

Sellers First Home Solutions provides homeowners with information about multiple selling solutions, including but not limited to: (a) direct cash purchase offers; (b) direct buyer offers; and (c) traditional MLS listing services through a licensed real estate agent.

All cash offer estimates provided on this Site or through our representatives are preliminary, non-binding estimates only. They are based on property condition, comparable sales data, market conditions, and other factors at the time of assessment. Final offers may differ materially from estimates.

We acquire properties at wholesale pricing, typically calculated as approximately 75% of the After Repair Value (ARV) minus estimated repair costs. No representation is made that any offer constitutes the highest price achievable for your property. Sellers are strongly encouraged to obtain independent valuations and to consult with independent legal and financial counsel before accepting any offer.

Participation in any offer program is entirely voluntary. No offer is binding until executed in a written contract signed by all parties in compliance with Texas Property Code § 5.021.

For listing services, commission rates, timelines, and marketing strategies are disclosed separately in the Listing Agreement as required by TREC. Nothing on this Site constitutes a listing agreement or creates an agency relationship.

4. Fair Housing Act Compliance

Sellers First Home Solutions is committed to full compliance with the Federal Fair Housing Act (42 U.S.C. §§ 3601–3619) and the Texas Fair Housing Act (Texas Property Code Chapter 301).

We do not discriminate against any person in the purchase, sale, rental, or financing of housing on the basis of race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected by federal or state law.

Any advertising, marketing, or communication from Sellers First Home Solutions is intended to reach all qualified property owners uniformly without targeting or excluding any protected class.

If you believe you have been subject to unlawful housing discrimination, you may file a complaint with the Texas Workforce Commission Civil Rights Division or the U.S. Department of Housing and Urban Development (HUD) at www.hud.gov/fairhousing.

5. Texas Deceptive Trade Practices Act (DTPA) Notice

Sellers First Home Solutions operates in compliance with the Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code §§ 17.41–17.63) ('DTPA').

We do not make false, misleading, or deceptive representations regarding our services, offers, or pricing. All material information regarding our offer methodology, including the 75% ARV minus repairs formula, is disclosed clearly on this Site and in our communications.

If you believe a representation made by our company was false or misleading, please contact us in writing at info@sellersfirsthomesolutions.com before pursuing any legal remedy, as Texas law may require written notice before a DTPA claim can be filed.

6. Website Use & Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Sellers First Home Solutions or its content suppliers and is protected by applicable intellectual property laws.

You may access and use this Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without our prior written consent.

You agree not to use the Site for any unlawful purpose, to submit false or misleading information, to engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Site, or to attempt to gain unauthorized access to any portion of the Site.

We reserve the right to terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms.

7. Lead Capture Forms & Communications

By submitting a form on this Site, you consent to being contacted by Sellers First Home Solutions and its representatives via telephone, email, or text message at the contact information provided, including by automated means, for the purpose of discussing real estate services.

Consent to receive marketing communications is not a condition of any purchase or service. You may opt out of communications at any time by replying STOP to text messages, clicking unsubscribe in emails, or contacting us at info@sellersfirsthomesolutions.com.

We do not sell, rent, or share your personal information with third parties except as described in our Privacy Policy or as required by law. Any information submitted is subject to our Privacy Policy.

8. Disclaimer of Warranties

THIS SITE AND ITS CONTENTS ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of information on the Site, including estimated property values or market data.

Real estate valuations, market analyses, and neighborhood data provided on this Site are for informational purposes only and do not constitute a certified appraisal. A licensed appraiser or broker price opinion may provide a more accurate valuation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELLERS FIRST HOME SOLUTIONS, ITS OFFICERS, DIRECTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THIS SITE OR OUR SERVICES.

Our total liability to you for any claim arising from your use of this Site or our services shall not exceed the amount of any fees paid by you to us in connection with the transaction giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this Site shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class or representative action.

Nothing in this section limits your rights as a consumer under Texas law, including rights under the DTPA.
